The proposal in this quote is the property of Forklift Systems, Inc. (FSI) and is confidential and proprietary. Unauthorized disclosure could be harmful to FSI, and by acceptance, the prospective buyer agrees not to publish, copy or reproduce the contents without the express written consent of FSI. You will not use such information for any other purpose than for the consideration of an FSI-supplied system and will return any or all information contained herein to FSI upon request.
Your signature on this proposal constitutes an order. You may not cancel or modify this order without the written consent of FSI. If FSI consents to a cancellation of the order, you agree to pay FSI a minimum of 20% of the total amount of the order. If all costs, expenses and fees incurred by FSI exceeds 20% of the order, you agree to pay all costs, expenses, and fees incurred by FSI for said order. If a cancellation or modification request is not granted, FSI will deliver the equipment and items within this order, and payment in full will be due from you for such items.
This Agreement supersedes all agreements, either oral or in writing, with respect to the subject matter of this Agreement and contains all of the covenants and agreements between the parties. No verbal agreement or conversation with any officer, agent, or employee of FSI before, during, or after the execution of the Agreement shall affect or modify any of the terms or obligations of this Agreement.
